Terms of Service for FitFlash

Please read these Terms of Service ("Terms") carefully before using the FitFlash mobile application ("the App") operated by FitFlash ("we," "us," or "our").
By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.
1. Account Registration
To use certain features of the App, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
2. Subscriptions and Payments
The App offers subscription plans that provide access to premium features. By subscribing to a premium plan, you agree to the pricing, billing, and renewal terms as presented to you at the time of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage your subscriptions and turn off auto-renewal through your account settings in the App Store or Google Play Store.
3. User Content
You retain all rights to any content you submit, post, or display on or through the App ("User Content"). By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in any existing or future media.
You represent and warrant that: (i) you own the User Content or have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.
4. Prohibited Uses
You agree not to use the App:
- In any way that violates any applicable law or regulation
- To transmit any material that is defamatory, obscene, or offensive
- To impersonate or attempt to impersonate another person
- To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App
- To attempt to gain unauthorized access to the App or related systems
5. Intellectual Property
The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of FitFlash and its licensors. The App is protected by copyright, trademark, and other laws.
6. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach the Terms.
7. Limitation of Liability
In no event shall FitFlash, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
8. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FitFlash is established, without regard to its conflict of law provisions.
